Terms of sale
Article 1. Acceptance of the conditions of sale
The conditions of sale apply between Em Archives and any person wishing to make a purchase (hereinafter referred to as "the buyer") on the current site.
The buyer acknowledges having read, at the time of ordering, the particular conditions of sale set forth and expressly declares to accept without reserve. These special conditions of sale will be the only ones applicable to the contract concluded.
Article 2. Products
The products offered by Em Archives are vintage or second-hand, they can thus bear the marks of time (stain, hole, repair, mending, etc.). The description of the products as well as the photos state these possible signs of wear, however in the even of a sign of wear unspecified, it would be involuntary. A wear mark cannot in any case justify the cancellation of the sale, insofar as wear is inherent in the nature of the product.
The sizes indicated on the labels of vintage and second-hand products rarely correspond to current size standards, therefore the description of the products indicates the size estimated according to current French/European standards as well as measurements taken flat and from seam to seam. In doubt, the buyer is recommended to contact Em Archives before making their purchase, in order to obtain advice and /or additional measurements. In no case can a problem of size justify the cancellation of the sale.
Article 3. Prices
The prices of the products are expressed in euros, excluding delivery costs and taxes or customs fees applicable in the State in which the buyer receives the order. Em Archives reserves the right to modify its prices at any time.
The delivery costs invoiced to the buyer when ordering constitute a participation in the shipping price (french postal service La Poste), packaging price and logistics costs. They are calculated automatically when ordering based on the weight of the items.
The taxes and customs fees applicable in the State in which the buyer receives the order, are the exclusive responsibility of the buyer and can in no way justify a cancellation of the sale. In the event that the order is returned because the buyer refused to pay the taxes and customs fees applicable to the order, he could in no case request a refund from Em Archives.
Article 4. Payment
Payments are made through the secure Stripe platform.
Article 5. Delivery
After receipt of full payment from the buyer, orders are shipped with the carrier La Poste (french postal service) in Colissimo (tracked package), to the contact details indicated by the buyer at the time of the order. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility for the carrier to deliver the order.
In the event that the buyer wishes to take out insurance for the shipment of the order, he must contact Em Archives (emarchives.shop@gmail.com) before placing the order so that the delivery price is adjusted accordingly.
For deliveries outside France, the buyer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of the order. Em Archives releases itself from all legal responsibilities if the payment of taxes was not made by the buyer.
Em Archives is not responsible for any loss or damage to packages during transport. Em Archives cannot reimburse the buyer for the order, should such a possibility occur. In case of damage, it is advisable to take photos of the package in order to express reservations with the carrier within 48 hours of receipt.
When the buyer is not present at the address indicated at the time of delivery, the carrier makes the package available for collection by the buyer. In the event that the buyer has not collected the package within the time period provided by the carrier, and it is returned to Em Archives, the buyer will not be able to claim reimbursement for his/her purchase. He will have to pay the delivery costs again for the reshipment of his package, under all of the aforementioned delivery conditions.
Article 6. Returns
In view of the vintage or second-hand nature of the products offered, Em Archives is unable to accept returns.
Article 7. Personal data
Em Archives undertakes not to communicate to third parties the personal information of the buyer communicated when ordering. This information, which is essential for order processing, can be changed at any time and upon request, or may be deleted in accordance with the General Data Protection Regulations.
Article 8. Applicable law
This contract is subject to French law. In the event of a dispute, only the French courts will have jurisdiction.
